OADA Provides Two Resources to Assist Dealers with FFCRA Compliance

OADA, in conjunction with Fisher Phillips, has prepared two useful resources to help dealers as they begin to navigate the paid leave provisions of the Families First Coronavirus Response Act (“FFCRA”) that went into effect on April 01, 2020.  The FFCRA requires employers to provide eligible employees with paid sick leave if they qualify under the law.  An employer will get fully reimbursed for those paid leave expenses through a dollar-for-dollar tax offset against payroll taxes and where additional funds are owed, the IRS will send a refund as quickly as possible. 

In order to assist dealers, OADA is providing two additional resources. These are: 

  • FFCRA Leave Request Template. This is a template form to assist dealers in ensuring they are collecting all the essential information to be eligible for the reimbursement. This document can be customized to meet your individual dealership’s needs.  
  • Human Resources Guide To The FFCRA Leave Request. This guide takes a step-by-step approach to help dealers navigate the common issues and questions we foresee in this process. This document will continue to be updated as we learn more about this process and get more guidance from the DOL or IRS.

Please note, the DOL’s and IRS’ interpretations of the FFCRA are continuously changing.  Therefore, we strongly encourage all dealers to continue to consult with their labor and employment counsel and follow the Department of Labor’s Q&A Guidance HERE. OADA will continue to try and provide relevant and timely assistance as it becomes available and will update the guidance accordingly.
