Have you ever had a workers' comp claim, and aren't really sure where to start? What happens after the accident investigation? How do you handle the myriad of HR issues that are sure to pop up? What if the injured worker is admitted to the hospital? Do you have to report that to OSHA?
OADA received a number of calls regarding workers' comp questions on the legal hotline. Most of these arise from the complications that occur after an employee is injured on the job, including the HR issues that are a reality in a lot of dealerships. In response, we have revamped this year's seminar series to talk holistically about safety measures to prevent workplace injuries, manage injured workers' claims, and address common issues that arise in the aftermath of an injury. We will take you through several scenarios where an injury has occurred, and discuss each from the following perspectives:
- Safety - prevention before an injury and preventing injuries from re-occurring;
- Managed Care - managing medical services and the inherent costs;
- Cost Containment / Third Party Administrator - understanding how claims impact your premium and how you can influence / reduce those costs;
- Legal - how to manage the legal implications of workers' compensation leaves and how other laws and regulatory agencies impact those decisions
Consider the following:
- Linus is a full-time salesperson. He was on his way across the lot to retrieve a vehicle when he slipped and fell on ice, wrenching his back and hitting his head on the pavement. What do you do?
- Charlie is a parts driver, and was driving a dealership vehicle to deliver parts to another dealership when he was rear-ended. Charlie waited several weeks to seek treatment, and is now off work with a back injury. What do you do?
- Lucy is an administrative assistant and part-time cashier. She has received disciplinary action several times. Lucy also plays recreational softball. She tripped and fell at work, injuring her arm. Her doctor eventually cleared her to return to work, but Lucy indicates she is still suffering from shoulder pain and can't return to work. What do you do?
OADA has assembled a panel of experts, including representatives from Sedgwick, ComplyNet, and Fisher Phillips, to walk you through each of these scenarios from a practical perspective. Throughout the course of the presentation, the discussion will include:

In addition, you will receive an update on changes at the BWC from Sedgwick. Attorneys from Fisher Phillips will cover what happens at a workers' comp hearing, and ComplyNet will provide a safety round-up at the conclusion of the case studies. There will be ample time to ask questions, and the seminar will provide you with two hours of needed BWC credit for those dealers that had a claim between July 1, 2021 and September 30 2022.
